1. About these terms

DesiMachines (desimachines.com) is run by Desi Machine Pvt. Ltd., CIN U66190WR2026PTC293360, registered office P-30, Block B, Lake Town, Kolkata 700089, West Bengal (“DesiMachines”, “we”, “us”). These Terms & Conditions apply to your use of our website, forms, tools, WhatsApp and SMS messages, notifications and any other service we offer.

You accept these terms when you use the website, and each time you submit a form, verify your mobile number or list a machine. Our Privacy Policy and Disclaimer form part of these terms. If you do not agree, please do not use DesiMachines.

You must be 18 or older to use our forms or list a machine. If you use DesiMachines for a business, you confirm that you are allowed to accept these terms for that business.

2. What DesiMachines is, and what it is not

• DesiMachines publishes information about construction equipment and helps buyers get in touch with manufacturers, their dealers, lenders and insurers.
• We are not a manufacturer, dealer, seller, bank, NBFC, insurer, insurance broker or corporate agent, and we do not act as the agent of any of them unless a page clearly says so.
• We do not sell machines, take orders, collect payments, deliver machines or handle returns and refunds. Any purchase, hire, loan or insurance policy is a contract between you and that business.
• Any advertising or sponsored content on DesiMachines is labelled as such. You never pay us to use DesiMachines.
• We cannot promise that a brand, dealer, lender or insurer will contact you, quote a price, give you a loan or accept your application.

3. Your enquiries

• When you send an enquiry, you ask us to pass it on so that you can get prices or information. You agree that we may share your details as set out in our Privacy Policy: with the manufacturer of the machine and its authorised dealer, and with lenders or insurers only when you ask about finance or insurance.
• Give accurate details, and your own mobile number. Do not send an enquiry for someone else without their permission.
• Do not send fake, repeated or automated enquiries. We may ignore or delete them.

4. Prices, information and tools

Prices on DesiMachines are indicative ranges, not offers. Specifications come from brand material. Calculators and the machine finder give estimates from the numbers you enter. News, guides and some WhatsApp replies are prepared with the help of AI tools and can contain mistakes. The Disclaimer explains the limits of each in detail. Always confirm what matters with the dealer, lender, insurer or official source before you pay or sign.

5. Mobile verification and login

• Some features ask you to verify your mobile number with a one-time password (OTP). Use only a number that belongs to you.
• Keep your OTP and device secure. You are responsible for what is done through your verified number on DesiMachines.
• We may block verification, logins or features if we see misuse, for example many OTP requests or use of other people’s numbers.

6. Rules for using the site

You must not:

• copy, scrape, download or collect prices, specifications, comparisons, dealer details, listings or other data from DesiMachines in bulk, by hand or with bots, crawlers or scripts, except normal indexing by search engines that follow our robots.txt;
• use our content or data to build a competing database, product or service, or resell it;
• get around mobile verification or any other access control, or use dealer or seller contact details for bulk or unwanted marketing;
• pretend to be someone else, or claim a link with DesiMachines that does not exist;
• send spam, malware, or anything that damages, overloads or interferes with the site or other users;
• try to access accounts, systems or data you are not allowed to see, or test our security without our written permission;
• use DesiMachines for anything unlawful, fraudulent or misleading.

7. Listing a machine for sale or rent

These rules apply if you use List your machine or send us machine details in any other way.

What you promise

• You own the machine, or you have the owner’s permission to sell or rent it.
• Everything you tell us is true and complete, including the year, working hours, condition, accident or repair history, and any loan or hypothecation on the machine.
• The machine is not stolen, seized or under any legal dispute you have not told us about.
• Photos and videos are recent, of this machine, and taken by you or someone you authorised.
• You will tell us promptly when the machine is sold, rented or no longer available.

Photos and documents

• Upload real, unedited photos. AI-generated, AI-edited or digitally altered photos are not allowed, and neither are photos copied from other websites or photos carrying another website’s watermark.
• Do not upload photos of identity documents, or of other people’s faces or personal details. Where we ask for a document such as an RC page, cover any number you do not want to share.

How we handle listings

• We review every submission before anything is shown or shared. Approval means the listing meets our rules on the face of it. It does not mean we have inspected the machine or verified what you told us.
• We may ask for more information, reformat the details, decline, pause or remove a listing at any time, and we may stop you from listing again if you break these rules.
• The sale or hire is between you and the buyer or hirer. You are responsible for the price, payment, taxes, transfer of registration, loan closure letters and delivery.
• You allow us to store, display, format and share your listing, photos and videos in India and abroad, to find buyers or hirers and to promote the listing, for as long as it is active and for our records afterwards as our Privacy Policy allows. You keep ownership of your photos.
• If we charge for any listing service, we will tell you before the charge applies.
• We will remind sellers of these rules at least once every three months.

8. Content you must not post or send

In a listing, message, review, comment or any other content you give us, you must not include anything that:

• belongs to another person and you have no right to share;
• is obscene, invades someone’s privacy, including bodily privacy, or is harmful to children;
• insults or harasses anyone on the basis of gender, caste, religion or any other ground, or encourages money laundering or gambling;
• infringes a patent, trademark, copyright or other intellectual property right;
• misleads about where it came from, or is knowingly false or untrue;
• impersonates another person;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries, or public order;
• contains a virus or other harmful code;
• breaks any law for the time being in force.

If you break these rules, we may remove the content, suspend or end your access, keep records, and report the matter to the authorities where the law requires.

9. Messages, calls and notifications

• After you send an enquiry or list a machine, we may call, SMS, email or WhatsApp you about it, as described in our Privacy Policy. Reply STOP on WhatsApp, or tell us, to stop.
• Some WhatsApp replies are prepared with the help of automated tools, and a member of our team takes over when needed. They are general information, not a quotation, an offer or professional advice.
• Do not send us passwords, OTPs, bank details, Aadhaar numbers or other sensitive information in messages.

10. Our content and intellectual property

The design, text, compilations, price and specification databases, comparisons, calculators, software, the DesiMachines name and logo, and other material we create belong to Desi Machine Pvt. Ltd. or our licensors, to the extent rights exist in them. You may view pages, print a copy for your own use and share links. Any other use, including copying, republishing or commercial use, needs our written permission.

Brand names, logos, product photos and brochures of manufacturers, lenders and insurers belong to their owners. We show them only to identify their products and services, and showing them does not mean the owner is connected with or approves DesiMachines. See section 5 of the Disclaimer.

11. Copyright, trademark and other content complaints

If you believe content on DesiMachines infringes your copyright, trademark or other rights, or breaks section 8, write to our Grievance Officer at legal@desimachines.com with:

• your name, address, phone number and email;
• the work, mark or right concerned, and proof that it is yours or that you act for the owner;
• the exact page link and the content you want removed or corrected;
• a statement that the information in your complaint is true, and your signature.

We act on complaints within the time the law sets, including within 36 hours for valid copyright notices, and we may tell the person who supplied the content and consider their response. Sending a false or bad-faith complaint may make you legally responsible.

12. Links and dealings with others

DesiMachines links to websites and services run by others, including brands, dealers, lenders, insurers and government portals. We do not control them and are not responsible for their content, offers, products, services or privacy practices. Any dealing you have with a dealer, seller, buyer, lender, insurer or other business you find through DesiMachines is between you and them. Check who you are dealing with before you pay, and pay only against a proper invoice or receipt in their name.

13. Limits on our liability

• DesiMachines, its content and tools are provided “as is” and “as available”. We do not promise that information is complete, correct or current, or that the site will always be available or free of errors.
• To the extent the law allows, we are not liable for: decisions you make on the basis of our information, tools or messages; anything a manufacturer, dealer, seller, buyer, lender or insurer does or fails to do; the condition, price or delivery of any machine; or any indirect, incidental or consequential loss, or loss of profit, business, data or opportunity.
• To the extent the law allows, our total liability to you for any claim about DesiMachines is limited to ₹5,000.
• Nothing in these terms limits liability for fraud, gross negligence or wilful misconduct, for death or personal injury caused by our negligence, or any right you have as a consumer under the Consumer Protection Act, 2019 or any other law that cannot be limited by agreement.

14. Your responsibility to us

If you break these terms, for example by listing a machine you have no right to sell, posting false or infringing content or scraping our data, you agree to make good the reasonable losses, costs and legal fees we suffer because of claims by others arising from it.

15. Suspension and ending access

We may suspend or stop your access to all or part of DesiMachines, remove content, or refuse service if you break these terms or the law, or if we need to protect users, our team or the service. You can stop using DesiMachines at any time and ask us to delete your data as our Privacy Policy explains. Sections that by their nature should continue, such as 10 to 14 and 17, continue after your access ends.

16. Grievance Officer and complaints

For complaints about content on DesiMachines, a listing, these terms, or your personal data, contact our Grievance Officer:

• We acknowledge complaints within 24 hours and resolve complaints about content and listings within 7 days. Requests about your personal data are answered within one month.
• We act on orders from a court or an authorised government officer within the time the law sets.
• If you are not satisfied with our decision on a complaint about content, you may appeal to the Grievance Appellate Committee under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, within 30 days.
• Consumers can also contact the National Consumer Helpline on 1915 or at consumerhelpline.gov.in.

17. Governing law and disputes

These terms are governed by the laws of India. Subject to the next sentence, the courts at Kolkata, West Bengal have jurisdiction over any dispute about DesiMachines or these terms. If you are a consumer, nothing here stops you from approaching a consumer commission or court that the law allows, including where you live. We will not force a consumer dispute into arbitration.

18. Changes to these terms

We may change these terms when our services or the law change. The effective date and version at the top of this page show the latest version. Changes apply from that date to your use after it. If a change materially affects sellers with active listings, we will tell them before it applies.

19. General

• These terms, with our Privacy Policy and Disclaimer, are the whole agreement between you and us about DesiMachines.
• If a court finds any part of these terms invalid, the rest stays in force.
• If we do not enforce a term straight away, we can still enforce it later.
• We are not responsible for delays or failures caused by events outside our reasonable control, such as network failures, natural disasters or government action.
• We may transfer our rights under these terms to a company that takes over DesiMachines.
• If these terms are translated, the English version applies where the two differ.
• Notices to us must be sent to legal@desimachines.com.
