Zilla parishad contractor registration in Maharashtra is a separate list kept by the Rural Development Department, not by PWD, and it is compulsory for development works under the Zilla Parishad, Panchayat Samiti and Gram Panchayat. The rules in force are the department’s GR of 2 December 2016. They set 13 civil classes, from Class 9 at Rs 2 lakh to Class 1A with no limit, with fees from Rs 2,000 to Rs 40,000. You apply on paper to the Executive Engineer (Works) of the ZP, and from Class V upward you must own one of three listed sets of machinery. The first registration lasts three years, and each renewal up to five.

Thirteen classes, three groups of machines, and one office that receives every file. That is the whole system for working on rural roads, school buildings, water schemes and village works under a Zilla Parishad in Maharashtra, and most of what circulates about it online is out of date. The class ladders you see quoted, Class I to VII with Rs 3 crore at Class II, belong to older or different rule books.

What follows is read directly from the Rural Development Department’s own resolutions. Other states run their own panchayat works registers under their own rules, so if you work outside Maharashtra, treat this as a map of the questions to ask, not the answers.

Why ZP work needs its own registration

Since April 2007 Maharashtra has kept rural works contractors on a separate register. The 2016 GR (Sankirna-2016/PraKra.148/Yo-9) replaced the 2007 one and says registration with the Rural Development Department is mandatory for works under all three tiers of Panchayati Raj. Your PWD contractor registration is a different list under a different rule book, and so is a water resources enlistment, covered in our piece on irrigation department contractor registration.

Later resolutions confirm the 2016 rules are still the base. A GR of 7 December 2021 on action against contractors and a GR of 5 April 2023 on unemployed engineers both classify contractors by the 2016 classes.

Zilla parishad contractor registration classes and limits

The limit is the estimated cost of a single work you can take. Solvency, turnover and work in hand are the minimums you must show. Figures are in Rs lakh except the fee.

Class Work up to Solvency Avg. turnover Work in hand Fee (Rs) Approved by
1A Above 2,500 (no limit) 150 850 450 40,000 State (RDD)
1B 1,500 to 2,500 150 550 450 35,000 State (RDD)
1C 750 to 1,500 150 300 450 35,000 State (RDD)
2 750 75 200 300 30,000 State (RDD)
3 300 30 90 150 25,000 State (RDD)
4 150 15 60 80 20,000 CEO, ZP
4A 90 9 40 60 15,000 CEO, ZP
5 50 5 25 30 10,000 CEO, ZP
5A 30 3 15 20 7,500 CEO, ZP
6 15 2 7.5 10 5,000 EE (Works), ZP
7 7 1 1.5 3 3,000 EE (Works), ZP
8 3 0.5 1 1.5 2,000 EE (Works), ZP
9 2 0.25 0.5 1 2,000 EE (Works), ZP

Electrical contractors have their own ladder, Class A (no limit) down to Class E (Rs 2 lakh), with fees from Rs 25,000 to Rs 3,000. Within Class 1, the sub-class is set by the higher of 4.5 times your lowest annual turnover or 3 times your highest, across the last three to five years on your income-tax clearance certificate.

Who you must employ

Classes I and II need two civil engineering graduates, four civil diploma holders and six ITI-trained civil assistants, half of them with five years’ experience. Classes III and IV need one graduate, one diploma holder and two ITI assistants. Classes IVA and V need one diploma holder and one ITI assistant.

For Classes I to V the engineers must be domiciled in Maharashtra and on your rolls within three months of registration. The proof the rules ask for is your professional tax registration, EPF registration and the latest EPF challan. A contractor who cannot show them is not allowed to tender for further work, and at renewal you must show the engineers were employed throughout.

The machinery test from Class V upward

This is where the ZP rules differ most from other registers, and where a machine owner has an edge. From Class V up you file a list of the machinery you own, with its condition and location, and you must hold at least one of three groups in good condition. Electrical contractors are exempt.

Group and machine Class 1 to 3 Class 4 Class 4A Class 5
Group 1: trucks, tippers or tractor-trolleys 4 3 1 –
Group 1: concrete mixers / vibrators 3 / 3 2 / 2 2 / 2 1 / 1
Group 1: 5 HP pumps / centering (sq m) 2 / 500 1 / 300 1 / 200 1 / 100
Group 2: trucks, tippers or tractor-trolleys 10 6 4 1
Group 2: excavators 2 1 – –
Group 2: road rollers / vibratory rollers 2 / 1 1 / – 1 / – –
Group 2: water tankers / air compressors 2 / 2 1 / 1 1 / 1 –
Group 2: concrete mixers / vibrators 2 / 2 1 / 1 1 / 1 1 / 1
Group 3: trucks, tippers or tractor-trolleys 6 3 2 1
Group 3: road rollers / vibratory rollers 2 / 1 1 / – 1 / – –
Group 3: asphalt mixer and boiler 1 1 1 –
Group 3: drum mix plant, sensor paver, asphalt sprayer 1 each – – –
Group 3: concrete mixer / vibrator 1 / 1 1 / 1 1 / 1 1 / 1

Group 1 also asks for a mechanical hoist at Classes 1 to 3. Group 2 is the earthwork set: for a Class 4 file that means one excavator such as the Tata Hitachi EX 210 Infra, one road roller, six tippers or tractor-trolleys and a concrete mixer. Group 3 is the bitumen road set.

Ownership is proved with the purchase invoice and a copy of the RC book, plus a certificate from the Assistant Chief Engineer (Mechanical) where one applies. Hired machines do not appear anywhere in the test. If you sell or dispose of a listed machine later, the rules say you must tell the registering authority at once, so a machine you plan to sell is a weak one to build a class on. If you are buying to reach a group, equipment finance on a new or used machine still gives you an invoice and an RC in your name.

Documents, fee and the three-month clock

The application goes in the Annexure A form to the Executive Engineer (Works) of the ZP. For classes the CEO or the state approves, the Executive Engineer forwards it. With it you file:

  • a solvency certificate from the Collector, the SDO or a scheduled bank branch in Maharashtra, not more than 12 months old (our guide to the solvency certificate covers how banks issue one)
  • work-done certificates signed by an officer of Executive Engineer rank or above
  • an up-to-date income-tax clearance certificate
  • the technical staff list with qualifications, and the machinery list with ownership proof
  • the partnership deed and power of attorney, attested, where they apply

You also need a registered office in Maharashtra. Experience is tested by at least two sizeable works, each worth no less than the limit of the class two steps below the one you want. Private works count at half their value toward turnover and work in hand. The 2016 rules still ask for a sales-tax registration certificate, a clause written before GST, so ask the division what it accepts in its place.

Half the fee is paid upfront as a non-refundable application fee, and the balance only if you are registered. If the division finds you unfit for the class you asked for, it can consider you for a lower one without a fresh application fee. Each authority has 30 days, and the rules say every case should be settled within three months. If you are refused, appeal lies to a committee at Mantralaya.

The rules describe a paper application. The online PWD e-registration system is for PWD’s own register, and we found no official statement that ZP registration runs through it, so check with your ZP Works Division before you file.

Validity, renewal and how a registration is lost

The first registration is valid for three years. Apply for renewal three months before expiry, with a solvency certificate no older than a month. A renewal runs for up to five years. If your renewal was filed on time and the office is slow, the Executive Engineer can extend validity by 180 days, once. If you miss the date, the registration is treated as cancelled and you start again from scratch.

Two quieter rules catch people out. You must file an annual return in Annexure D by 30 April each year. And a contractor who wins no contract within five years of registration or renewal is to be removed from the list. Upgrading is not normally considered in the first two years.

The December 2021 GR sets out penalties. The grounds include defective work, a false bank guarantee, bogus documents, changing partners or address without telling the department, and not registering workers or not paying EPF or labour cess. For Classes 4 to 9 the Additional CEO of the ZP decides. The heavier penalties are downgrading, removal for one year, or removal for three years or more with your name published on a blacklist. Our piece on blacklisting of contractors covers how to answer the show-cause notice.

Routes for engineers, labour societies and retired officers

The Rural Development Department GR of 5 April 2023 gives educated unemployed civil engineers their own route. A graduate or diploma holder domiciled in Maharashtra can register within 10 years of qualifying, in Class 5 for works up to Rs 50 lakh. The registration lasts 10 years. The first work is capped at Rs 15 lakh, and up to Rs 100 lakh of works can come without open competition: below Rs 10 lakh by lottery, Rs 10 lakh and above by e-tender among the group.

Works a Gram Panchayat declines go to a ZP committee chaired by the Additional CEO, which meets on the first of every month and allots works of Rs 5 to 15 lakh in the ratio 26:40:34 between labour co-operative societies, unemployed engineers and regular registered contractors. Nobody in the scheme can hold more than three works at once. Works of certain types up to Rs 5 lakh, including transport, borewell drilling and hot-mix plant and paver work, are reserved for engineers registered in this category.

Labour co-operative societies are registered in Class V, VI or VIII for three years, on a certificate from the co-operative registrar in place of a bank solvency certificate. Retired state engineers of Executive Engineer rank and above can enter at Class V, and lower ranks at Class VI.

Where the work is advertised

Since a GR of 27 May 2021, works above Rs 10 lakh, taxes included, at ZP, Panchayat Samiti and Gram Panchayat level must be e-tendered. The earlier threshold was Rs 3 lakh. Those notices sit on the state e-tender portal, and your EMD is worked out per tender; the 2016 GR cancelled the old EMD-exemption certificates. To see live rural works in your district, browse current government construction tenders.

The bottom line

ZP work is open to small contractors in a way few registers are: Class 9 starts at a solvency of Rs 25,000 and a Rs 2,000 fee. The step that changes your options is Class V, where owned machines become part of the test and the limit reaches Rs 50 lakh. Read the 2 December 2016 GR yourself, file with the Executive Engineer (Works) of the district where you work, and keep your renewal date and 30 April return in the calendar.

If you are building up a machinery group for Class V or IV, compare excavator prices and equipment loan options before you file, since the invoice and RC must be in your firm’s name.

Class limits, fees and procedures are taken from the Maharashtra Rural Development Department GRs dated 2 December 2016, 27 May 2021, 7 December 2021 and 5 April 2023. Rules, fees and procedures change; confirm current terms with your Zilla Parishad Works Division or an official source before applying.
