Bihar contractor registration is done department by department, not on one state list. Rural Works, Road Construction, Building Construction, Water Resources and PHED each register contractors under their own version of the Bihar Contractor Registration Rules, 2007. The Rural Works Department version, notified on 19 December 2007, has three classes: Class 1 for work of any amount, Class 2 up to Rs 3.50 crore and Class 3 up to Rs 70 lakh, with fees of Rs 2 lakh, Rs 1 lakh and Rs 25,000. Registration lasts five years, and you may bid only one class below your own.

In January 2024 a cooperative registered as a Class I contractor with Bihar’s Minor Water Resources Department had its bid for a Rs 43.45 lakh irrigation work rejected. The reason was not that it was too small. It was too big. On 20 March 2024 the Patna High Court agreed with the department: a Class I contractor can drop one class, not two.

Your class, and the department that gave it, decide which tenders you can open. This guide reads the Rural Works Department (RWD) rules from its own website and uses Patna High Court judgments for how other departments apply theirs.

Who registers you: one rule name, several rule books

The 2007 Rules repealed the 1996 Rules and are not retrospective, the Patna High Court said in 2016. What the name hides is that each works department issued its own text. In July 2021 the High Court noted that the Road Construction Department (RCD) rules are executive instructions, not a statute, and are mainly for registering contractors for roads and bridges. It also noted another set, labelled Rural, with “some variance”. In September 2024 a Division Bench put it plainly: the Rural Works Department rules apply only to the Rural Works Department.

So you register with the department whose work you want. Under the RWD rules, the registration officer is the Engineer-in-Chief or an officer not below Chief Engineer notified by the state. An RWD registration lets you tender anywhere in Bihar, but only for works of the RWD and its agencies. Patna High Court records show contractors holding Class I registrations with Water Resources, Building Construction and Rural Works, each issued by that department. PHED also registers contractors under the 2007 Rules and applies the same Rule 11 to debarment.

Bihar contractor registration classes, limits and fees

The RWD notification (No. 8123, dated 19 December 2007) lists three classes for road and bridge work. The fee is a one-time payment for the five-year term.

Class Can tender for work valued up to Registration fee Can also bid in
Class 1 Any amount Rs 2,00,000 Class 2 works
Class 2 Rs 3.50 crore Rs 1,00,000 Class 3 works
Class 3 Rs 70 lakh Rs 25,000 Its own class only

The “one class below” rule is Rule 4(d). In the 2024 case the contractor relied on a Road Construction Department letter of 22 January 2008 to argue that a higher class may bid in any lower class. The High Court said such a letter “cannot re-frame the provisions of Rules, 2007”. If you hold Class 1 and want small jobs, you cannot reach below Class 2 works.

Departments have also added classes. In a 2013 building works case, the State told the High Court that a Class 4 for works up to Rs 25 lakh had been inserted, which the court tied to a notification of 13 December 2011, leaving Class 3 the band from Rs 25 lakh to Rs 70 lakh. Check your own department’s class table before you pick.

What the RWD rules ask for, and what they do not

Rule 5 lists the documents: the Annexure A form, your PAN, proof of address, the fee, and for a firm or company its registration certificate, partner or shareholder names and deed or by-laws. The 2007 text asks for the fee as a bank draft payable to the Under Secretary, Rural Works Department, Patna. The department’s online portal guide shows the payment being made online instead.

Rule 6 bars three kinds of applicant, including any partner or shareholder of a firm: a person removed from government service or a government servant under suspension, anyone blacklisted or demoted by any department of the Government of Bihar, and anyone convicted of any offence. The application form adds a condition that catches families. You cannot tender in a circle where your husband, wife, mother, father, brother or sister is posted as Divisional Accountant, Junior Engineer or an officer above that rank.

At the registration stage there is no demand for a solvency certificate, turnover, engineers on payroll or owned machinery in the RWD rules. Those tests come later, in each tender’s qualification clause. A Bihar Medical Services and Infrastructure Corporation bid document reproduced by the High Court in August 2022, for example, asked every bidder to show key equipment “either owned or leased or by procurement against mobilization advances”. Its contractor portal also carries a bid capacity calculator, so read up on the bid capacity formula before you rely on its number.

For a small road contractor, that equipment line usually means a JCB 3DX backhoe loader for earthwork and drains, and a 20-tonne excavator such as the Tata Hitachi EX 210 Infra for bigger cuts and embankments. If a machine is the gap between you and a bid, look at construction equipment loans before the tender closes, not after.

We could not read the RCD or Building Construction Department texts on an official site, so their criteria are not listed here.

Unemployed engineers: Class 3 with reserved work

An RCD resolution (No. 1399, 31 January 2008) applies to the state’s works departments, and RWD adopted it by a letter of September 2009. An unemployed engineer with a degree or diploma registers in Class 3 for one zone of one department. Superintending Engineers set aside works of up to Rs 20 lakh for them, 15 percent of the zone’s allocation, take only financial bids, and do not award above the current schedule of rates. Tied rates go to a lottery. Earnest money is 1 percent, a bank guarantee is accepted, and the remaining 9 percent of security is cut from running bills. Once the engineer completes Rs 3.50 crore of work, the concessions end and the engineer is treated as a general contractor.

Applying online, renewal and changes

Applications now go through the department’s contractor portal. The RWD contractor checklist asks for PAN, Aadhaar, an email ID, a mobile number for OTP, a GST copy, a cancelled cheque, a passport photo and signature scans under 50 KB, and company or partnership papers where relevant. You must upload documents in colour and make the final submission within five days. The portal guide shows each application being accepted by both the Superintending Engineer and the Engineer-in-Chief, with a renewal countdown and a debarment list on the contractor’s dashboard.

Renewal under Rule 7 costs the same fee as Rule 3. You may apply one month before expiry, and Rule 8 gives a one-month grace period after expiry during which you can still tender. Rule 13 is the one people miss: any change in the original details of the registered individual, firm or company needs a fresh registration. A change in the power of attorney holder needs the department’s permission, and a change of address must be reported.

Department registration does not put you on the tender portal. Bihar’s state tenders run on eProc2, which needs its own vendor registration, and RWD’s eligibility note asks e-tender bidders to hold their own digital signature certificate. Each notice then sets its own EMD amount.

Blacklisting, suspension and demotion under Rule 11

The RWD Rule 11 lists twelve malpractices. The first five are misbehaving with officers, creating a law and order problem at tender time, threatening or attacking staff, forming a cartel to bid or boycott, and failing more than once to sign the agreement after award. One of these can mean permanent demotion to a lower class, and more than one can mean blacklisting. The other seven can lead straight to blacklisting: breach of agreement conditions, subletting without consent, selling government cement, steel or bitumen, forged security or documents, conviction for a criminal activity, tendering where a close relative is posted, and blacklisting by another government department. Suspension for a set period is also possible. A show-cause notice must come first, and you can appeal within 30 days to the department’s Commissioner and Secretary or Secretary.

Clause numbers differ between versions. Conviction is 11(a)(x) in the RWD text but 11(a)(ix) in the Water Resources version the court read in 2016, and false documents sit under 11(a)(vii) in the version RCD and Water Resources cite. Always read the clause your notice quotes against that department’s own text.

Date Court What it held
3 Nov 2014 Supreme Court (Suraj Nirman) A blacklisting order against a Bihar contractor stood, but the authority had to fix how long it would last.
17 May 2016 Patna HC, Division Bench No blacklisting merely for a pending criminal case unless the contractor is convicted.
7 Sep 2021 Patna HC Show-cause must come with the documents relied on and at least 15 days to reply; debarment cannot be indefinite.
4 Sep 2024 Patna HC, Division Bench Ten-year blacklisting upheld for hiding a debarment in another state, a period set by government guidelines.
13 Feb 2026 Patna HC, Division Bench A PHED debarment “in the next tender” had lapsed; the bid had to be reconsidered.
25 Feb 2026 Patna HC, Division Bench Five-year Water Resources blacklisting set aside; the department must first use the agreement’s defect clauses 16 and 17.

The 2016 criminal-case ruling came from a Water Resources registration and is also covered in our irrigation department contractor registration guide. The 2024 case warns anyone working in more than one state: the bid affidavit asked about blacklisting anywhere in India over five years, and leaving out a Rajasthan debarment cost ten years in Bihar.

The ten-year period in the 2024 case came from government guidelines. Office Order No. 201 of 14 March 2016, signed in the Water Resources Department, made amendments to the 2007 Rules after the Supreme Court’s 2014 order. Contractors challenged that order in 2026, arguing it was never published in the Gazette in the Governor’s name. At the last hearing we read, on 5 May 2026, the State had asked for four weeks to reply, so the question is open. Our guide to blacklisting of contractors covers how to answer a show-cause notice. If you also bid for central works, CPWD contractor enlistment follows a different rule book.

The bottom line

Pick the department first, then the class. If most of your work is rural roads, the RWD’s Class 3 at Rs 25,000 is the cheapest entry and covers works up to Rs 70 lakh across Bihar. Do not buy Class 1 to look bigger, because it locks you out of Class 3 jobs. Read the RWD 2007 Rules in full, diarise the renewal month, and disclose every past debarment on every bid.

Once registered, track live road, building and irrigation work on the government tenders board and match each notice to your class before you pay for the bid documents.

Classes, fees, validity and Rule 11 are taken from the Rural Works Department, Government of Bihar notification No. 8123 dated 19 December 2007 and its contractor portal checklist; the unemployed engineers’ terms from RCD resolution No. 1399 dated 31 January 2008; court positions from Supreme Court and Patna High Court orders dated 2014 to 5 May 2026. Other departments’ versions of the 2007 Rules may differ. Rules, fees and procedures change; confirm current terms with the registering department or an official source before applying.
